the latest victim a man in his 30s. he was stabbed to death last night. san jose police were called just before 8:30 and they say that the victim was outside of an apartment complex in the kenwood neighborhood. that's off monterey highway. he was attacked by a group of men who stabbed him multiple times. the victim later died at the hospital. police at this point don't know a motive and are searching for four suspects who ran from the scene. >> it's very vague at this point. four males possibly white or hispanic 18 to 20 and dark clothing possibly in a gray van that was seen leaving the area. >> reporter: this was the second homicide in san jose this week. on wednesday, a woman was shot and killed inside of her condo near tully road. police officers say that they are struggling with being understaffed. in 2008, the city had 1,409 police officers.

today there are 1,061. that's 348 less. as of the beginning of january, fewer than 600 officers have been assigned to patrol about one million residents. that means that any given time there are only about 70 on the streets. latest victim's name hasn't been released. the woman killed on wednesday was 43 years old and leaves behind two children. police have made no arrests. live in san jose, elissa harrington, cbs 5. at least one person has been arrested in a home invasion robbery in san jose, as well. it's according to the "mercury news." officers say two or three men armed with knives tied up an older couple in their home near leeland high school on monday. the home was ransacked. two cars were stolen. both cars have been found. was was driven in a rest -- one was driven know a reservoir. people in antioch are on high alert after a man tried to lure a boy into his car after school yesterday near sutter elementary. a fifth grade boy says a stranger approached him claiming he was sent by a family member to pick him up. the student said, i don't know

you, and quickly walked away. the suspect description is vague but reportedly driving a light blue '70s era car. new details in a shooting near a bart station earlier this week. police say two albany high school students who were shot wednesday were asked about their shoes first. it happened on a walking past near the el cerrito bart station after school let out. police didn't elaborate on the shoes. the teens are expected to make a full recovery. and the two shotters are still on the loose -- shooters are still on the loose. don't let drinkers get too drunk on super bowl sunday, the message being delivered to san francisco bartenders. cate caugiran reports that officials want 49ers to keep it in line on super sunday. >> reporter: good morning. city leaders want to make sure that super bowl celebrations are fun but clean and they want fans to keep this in mind as the bay area tries to bring a super bowl here in 2016 and

keep those knuckleheads out. that's the term that mayor ed's lee used to describe these people, just after the world series vandals set fire to a muni bus and destroyed businesses and rioted in the streets. now san francisco's mayor does not want a repeat performance. >> suggest that these are something that heavy alcohol during the times of celebration, inebriation sometimes doesn't help with people who want to maybe go beyond the bounds of the celebration. >> reporter: on 24th and van ness, bartenders say they know what they are up against and won't hesitate to cut you off. sfpd says we shouldn't tear down the city and should show the world that 49ers are high class fans. next sunday, though, the police department will be stepping it up. you can expect to see extra officers on patrol as you're celebrating on game day. live in san francisco, cate caugiran, cbs 5. i just don't get it. the tearing down the city.

frozen over pond near their home in amador county yesterday. authorities have been at the home several times during the week when the neighbors said the residents hadn't been seen. family friend says the 5-year- old victim was an outgoing child. >> she just went out and she would grab another kid and just take them and show them the ropes and just have fun with them. she was just a very happy kid. >> divers searched the pond where the bodies were found after a neighbor reported seeing a big hole in the ice. other headlines around the bay this morning, state senator from san mateo jerry hill is going to propose some changes in california's law about mountain lions. he wants the department of fish & game to be allowed to rescue injured or orphaned lions. currently it's illegal to rehabilitate them. two cubs were shot last month in half moon bay. the fate of the drakes bay

oyster company could be decided this afternoon. the company sued the u.s. interior department after its permit to operate at point reyes national seashore expired in november. today a federal judge will consider whether to allow the company to continue operating while the case is being heard. vice president joe biden is on the road today to rally support for the administration's gun control proposal. and he kicks it off in virginia. biden will hold a discussion with experts who worked on gun safety following the shooting at virginia tech. meanwhile senator dianne feinstein announced her own bill yesterday. it will eliminate high capacity magazines and ban assault weapons. but vice president biden downplayed the need for an assault weapons ban. >> i'm much less concerned, quite frankly, about what you call an assault weapon than i am about magazines and the number of rounds that can be held in a magazine. >> president obama also plans to travel to push gun control

this week. dianne feinstein got personal while introducing her assault weapons bill. feinstein talked about the day george moscone and harvey milk were killed at san francisco city hall. >> i was the one that found supervisor milk's body, and i was the one that put a finger in a bullet hole trying to get a pulse. once you have been through one of these episodes, once you see what the crime scene is like -- it isn't like the movies -- it changes your view of weapons. >> feinstein's bill would ban more than 150 assault style weapons and high capacity magazines. but she does concede that it has little chance of passing congress. a well-known crime fighter is pnc's pick to go after wall street -- president obama's pick to go after wall street. he nominate mary jo white to be the head of the securities and exchange commission. she was the first female u.s. attorney in manhattan. she led the successful

to see any major delays overty bay bridge. only some slight ones so far in the outer cash lanes. fastrak users get by okay. it's moving okay up the incline as well so we'll let you know as soon as they turn the metering lights on. now let's go to our maps. there's an accident in this area that we're watching northbound 238. it's on that connector ramp to northbound 880. so it's in the center divide but you can see we're already seeing a little bit of slowing on our sensors in that area so you may find a backup even though it's not on the main lines. westbound 580 a little stop and go 205 in tracy towards the dublin interchange especially heavy traffic now speeds under 40 miles per hour as you make your way through livermore. elsewhere golden gate bridge headlights are moving southbound towards san francisco and doyle drive. they wrapped up overnight roadwork farther north through marin county between the waldo tunnel and sir francis drake. and quick update no chains required getting out of town for the weekend no chains required right now towards the

sierra on 80, 50 or highway 88. that's a check of traffic. for more on these wet road conditions, lawrence has the forecast. >> widely scattered showers in the bay area this morning. fog is more of a concern. visibility is dropping down to a quarter of a mile in concord into napa. so watch out for that. you will see some patchy, dense fog early on. our high-def doppler radar showing you a few of those scattered -- scattered light showers hit and miss. foggy conditions out the door, chance of light showers and sprinkles outside even this afternoon a chance of a few light showers. i think mainly over the mountaintops. temperatures in the 50s and 60s. low pressure areas to worry about, this one to the south pumping up the moisture back into the bay area. but it's this guy in the gulf of alaska that will be paying a visit to the bay area this weekend to really drop the temperatures, keeping things unsettled and occasionally we may see some showers over the weekend, as well. all right. let's see if we can time this out. clouds early on today and a few scattered showers toward the afternoon, maybe a few more pop- up showers especially over the

mountaintops in toward the south bay. and then you can see that next cold front dropping in from the north into the bay area tomorrow morning bringing with it a chance of a couple of more raindrops and more much colder air. temperatures only into the 60s in the central valley, 40s in the high country. 50s and 60s for highs. next couple of days including the weekend, there is a chance we could see widely scattered showers but some very cold temperatures. some of those numbers struggling to get into the 50s as we get in toward saturday, sunday. >> cold is a relative term. 50s? >> compared to the east coast, yeah. >> no kidding. from "star trek" to "star wars," that's apparently the route for director j.j. abrams. the wrap reports disney lined him up to director a "star wars" blockbuster. disney has the rights to the franchise after buying lucasfilm last year. abrams is currently working on a "star trek" film. colin kaepernick is the talk of the bay area after leading the 49ers to their

valencia and 25th. workers say the super bowl is about having a good time within reason. >> it's supposed to be fun have a great time. don't be dumb. you know? let's just have a good time, have some drinks. be safe. don't destroy other people's property. you know? make it a fun night. >> reporter: here's another tall order for you. on super bowl sunday, city leaders suggested bartenders serving something other than hard alcohol and for fans to drink in moderation. it's something they want fans to keep in mind as they try to bring a super bowl here to the bay area in 2016. reporting live in san francisco, cate caugiran, cbs 5. there's been a rush to scoop up 49ers gear. but a lot of the stuff you see being sold on street corners is counterfeit. one vendor told us his gear was officially licensed but we checked with customs and it was counterfeit. one agent said the bargain prices are no bargain at all. >> downside is you're not getting a genuine product.

state-of- the-state address yesterday... brown heavily focused on the budget... which is in the black for the first time in over a decade. jerry governor brown laid out an optimistic vision for future of california in this state of the state. he focused on the budget, in the black for the first time in over a decade. >> california's back, its budget is balanced and we're on the move. i think i can. and over the mountain the little engine went. we are going to get over that mountain i have no doubt about it. >> brown credited state lawmakers for making bold spending cuts and praised californians for voting to raise taxes. we turn to our political insider phil matier who joins us live with the former san francisco mayor willie brown on this friday and guys, what did you think of the state of the state? how did the governor do? >> what did you think? the little engine that could.

is he doing it? >> you know, the 11 tries, this was probably his best. >> this is his 11th state of the state address. >> it is. no other governor matched that. >> it was amazing. i was in the chambers then and this guy was bouncing over everything. he was quoting the bible, quoting irish poets. he was quoting the king of spain. and he was doing the little engine that could all in one swoop. >> and in most cases, many of the people, what is he talking about? [ laughter ] >> members, i mean. however, he got a standing ovation. at some point when he talked about schools, and the situation of college of tuition, everybody gave him an ovation. he was well received. >> i got to tell you something. i was watching the members as he was speaking and i got to tell you, there are a number of democrats that were sitting on their hands half the time when he was speaking and some republicans. but even the democrats weren't sure which way he was going. >> well, it's a good thing you can't recognize whether these guys are democrats or republicans because some of

them never looked up. they were on their computers or they were e-mailing or they wer texting, paying no attention and only reacted when people around them did something. >> what goes through the guy's mind? it's all over the place sometimes. >> keep in mind that this was a speech that clearly jerry wrote. no one else could have figured it out including jerry. but it got him through longer than ever, longer than ever. he delivered the message about optimism. he delivered the message about jobs. he delivered the messessage about local control of schools. he really did one hell of a job and then left on high-speed rail. >> he got out of town. >> you have to tip the cap to the voters because my guess is this speech would have been entirely different if prop 30 didn't pass. that is his ticket to ride, right?

>> exactly. if prop 30 had gone down, this would have been his -- i don't know. it would have been -- i don't know what a comparable speeching would have been. >> i don't know if he would even have shown up to make a speech. but you have to understand, he was speaking beyond the borders of california. he was really sending a message to kerry, to joe biden and to hilly saying, i win re-election in 2014, i'll be around for 2016 and you'll have to have a conversation wit me. >> is he thinking about running for president? >> are you kidding me? that wasn't just a speech for california. that was a speech for young california. >> you're serious? >> totally! >> he knows his cousin. you know. >> 73, 74, though. >> come on. >> age is no longer an issue. >> the republicans ripped that speech apart saying he was overly optimistic and they are predicting doom and gloom. >> he balanced the budget. >> one incredible quality was

value in the process. a lot of investors worried that its higher end products are not being received as well overseas and emerging markets like china and india where samsung has made inroads as well as many other android-based devices that are cheaper some wall street analysts out there saying this could compel apple to make a lower end iphone in order to increase those sales. so that could pinch margins elsewhere so that's not an easy task ahead. apple is rebounding this morning. its shares are up about 1%. speaking of samsung, its galaxy line-up led to a 76% increase in profit in the latest quarter up to $6.6 billion. and according to strategy analytics samsung was the smartphone winner for 2012. sold 213 million smartphones apple in second with 136 million, nokia with about 35 million in third place. stocks off to a positive start today thanks to some stronger earnings, some companies like

procter & gamble, kimberly- clark and halliburton. dow up 35, nasdaq up 16, s&p up 5 points back to 1500. touched that level yesterday and it's going to see if it can hold on for the first time since december of 2007. frank and anne, back to you. >> thank you, kcbs radio's financial reporter jason brooks. well, a crackdown on consumer fraud cases involving healthcare for workers here in san francisco. a city law says restaurants are supposed to be setting aside a couple of dollars from each bill to help cover employee health expenses. city attorney says that's not always happening. today's crackdown announcement comes a week after a pizza company agreed to a $200,000 settlement for failing to do just that. bart trains are getting new security equipment that will also help riders stay connected. bart is buying communications devices that will send live video from the railcars to bart security and their control centers. those devices will also provide free wi-fi service now for the cars. that service is expected to be a lot more reliable than the

current wi-fi that's offered aboard the bart trains right now. 10 minutes before 7:00. and some sprinkles outside this morning. >> light showers out there this morning. but this weekend we have some big changes coming our way. some much colder air headed in our direction and maybe a few more showers. outside we go, our high-def doppler radar showing you some scattered showers around the bay area this morning. but i think throughout the day we are going to keep a chance at least a few more showers in the forecast and some fog out there. visibilities down to a quarter mile in napa and into concord this morning. so watch out for that, as well. this afternoon, we'll see a lot of clouds outside, maybe some more pop-up showers especially over the south bay mountains. temperatures will be in the 50s and also the 60s. i have a couple of lows to deal with one off the coast of southern california now. one in fact gulf of alaska. the one down in the south still spinning up moisture in our direction but the one to the north will likely bring very cold air and some unsettled weather to this bay area this weekend. here's the latest forecast model showing you some of those clouds outside and a few scattered light showers. we have a chance of that into the afternoon as well as we'll

foster city. eastbound 92 looks grade towards the east bay. bay bridge this is how now it is a light traffic day. the metering lights have been on since shortly after 6:00. but there's really not much of a wait at all getting into san francisco. if you commute the bay bridge every morning you know this is unusual. just slight delays in the middle lanes. couple of different spinouts accidents one in san leandro that's now cleared another new one southbound 880 at davis street is now off to the right- hand shoulder. so no delay between san leandro and oakland. and this problem spot also out of lanes on the connector ramp from northbound 280 to southbound guadalupe parkway. that's traffic. back to you guys. >> thank you. so if you were the parents of jim and john harbaugh, who are you going to root for on super bowl sunday? >> tough spot. john from the ravens decided to play a little prank on his family. he pretends to be a reporter from baltimore. >> question from baltimore, is it true that both of you like jim better than john?
